Federal law orders that every student is entitled to free and public education that is suitable to their educational needs and abilities. When school districts and families do not agree on special education issues, the Individuals with Disabilities Education Act (IDEA) protects a parent’s right to request a due process hearing. Each child learns differently, and most children’s learning needs can be met in a traditional classroom. Some children, however, have special learning needs and differ in how they require an Individualized Educational Plan (IEP). The request for and the following of the IEP plan can be challenging.
